I`m going around in circles and trying to find the terms of a data processing agreement with Microsoft for the O365 and SharePoint online services. A final update in the Online Terms of Service is an update list of key services in Appendix 1 – indications that some services are now SOC compliant. Microsoft is committed to complying with the GDPR and providing a number of products, features, documentation, and resources to help our customers meet their compliance obligations under the GDPR. Below is a description of Microsoft`s contractual obligations to its customers with respect to personal data collected from enterprise software: Microsoft Unified, Premier- and Consulting Customer Privacy Policy. “The OST/DPA update replaces the previous OST language allowing Microsoft to process customer data `solely to provide the customer with online services, including purposes consistent with the provision of those services, ` with more specific instructions and restrictions, ” Microsoft states in the new OST. But does the online service agreement contain a sny addition of data processor? Because, as I perceive, we need a signed DPA, because Microsoft processes the personal data of our employees when we use Office 365. That`s right? For professional services agreements that currently have no contractual obligation under the GDPR, the GDPR terms that will be added to those agreements are included in Appendix 2 of the Microsoft Professional Services Data Protection Amendment. Please note that these new GDPR terms only apply to the extent that Microsoft processes personal data subject to the GDPR. The Online Product and Service Terms are Microsoft`s terms of service for persistent and cloud technologies. These Terms are updated and published monthly online and are an integral part of the Customer`s License Agreements.

Although the terms apply to customers, they are generally not read by customers. At Quexcel, we study them every month and will inform you of the changes (most often via Twitter). Here are some important changes from the January 2020 editions of these legal documents. One of the key changes to the OST update is that Microsoft is not permitted to process customer or personal data for the purposes of “profiling, advertising, or other similar business or market research purposes, ” unless customer expressly authorizes it. For greater ability, beta or preview software, software that has been significantly modified, or any software licensed from Microsoft or our affiliates that is not publicly available or that is not licensed under the Microsoft Software License Terms, may be subject to different or minor obligations. Some products may collect telemetry or other data by default and send it to Microsoft. The product documentation contains information and instructions for disabling or configuring such a telemetry collection. Well, have you contacted support? support.microsoft.com/en-us/help/28808/microsoft-store-contact-support The DPA Online Service Terms cover issues relating to the ownership of processed data, the processing of personal data in accordance with the rules of the GDPR, infringement notifications, legal issues related to the transfer of data between countries, data storage, disclosure and compliance with requests for prosecution of data, the HIPC regulations and the new California Consumer Privacy Act (CCPA). Microsoft enforces the CCPA rules to all users in the United States. Microsoft extends the terms of the GDPR to all customers of generally available enterprise software products, those of us or our affiliates in microsoft`s license terms with effect from 25 May The license was granted on May 1, 2018, regardless of the applicable version of the company`s software, to the extent that Microsoft is a processor or processor of personal data associated with that software.

and as long as Microsoft continues to offer or support the release…
